New Insurance Act Makes Life Difficult for Injured Persons on Public Transit

Being involved in a motor vehicle accident of any kind can be one of the most traumatizing experiences you may ever have to go through. However, with that being said, if you are ever using public transit and are injured, it is to your benefit, for the vehicle to collide with another vehicle. Essentially, according to new amendments of the Insurance Act, passengers in a public transit vehicle may only file a claim, if the vehicle collides with another.

For many Canadian citizens, auto insurance is one of the most integral and daunting resources to helping you out when times are rough. On the one hand, by law if you own a vehicle, you have to own auto insurance. Through auto insurance, if you ever get into an accident, the insurance policy should cover your damages. On the other hand, as we noted, auto insurance is also daunting, this is because, the auto insurance industry seems to annually create new stipulations to make receiving your accident benefits difficult.

As we stated earlier, the new amendments to the Ontario Insurance Act, require that the public transit vehicle must collide with another vehicle, in order for you to file an accident benefits claim. This in turn, eliminates, any claim you should have been able to file, if a bus driver jams on their breaks, speeds after letting you on the bus, or makes awkward turns, and you sustain an injury. When an injury is created thanks to these examples, you and your loved ones will have to foot the bill for medical treatment, rather than the public transit company.

While the amendments to the Insurance Act make it appear as if hope is lost for filing a claim, this simply isn’t true. In reality, because the Insurance Act is becoming more specific for when you or a loved one can seek money from your auto insurance policy, the Insurance Act now basically justifies you filing a lawsuit against the public transit company.

For this reason, the new amendment is a bit of a head scratcher for attorneys across the province. Simply put, you used to be able to avoid going to court to settle a civil matter, because insurance would cover your damages. Now, because insurance no longer covers your damages, the courtrooms will be packed with people and their personal injury lawyers, seeking compensation from public transit companies.
